A rental shop may be willing to hand over a 125cc scooter after seeing only your passport. That does not automatically mean you are legally licensed to ride it on public roads.

A shop's rental requirements are its commercial rules. The law determines whether you are legally entitled to operate the vehicle.

It is not necessarily enough to make you legal on a 110cc, 125cc or 160cc scooter.

Vietnamese law recognises certain foreign driving documents, including an international driving permit issued under the 1968 Vienna Convention, together with the matching national licence for the vehicle category.

So before asking, "Will a shop rent this scooter to me?", ask the better question:

Am I legally entitled to ride this scooter in Vietnam?

Which Scooters Can a Foreign Tourist Ride?

The answer depends primarily on the vehicle's legal classification and your licence.

Under Vietnam's Road Traffic Order and Safety Law, a xe gắn máy (moped) is a two- or three-wheeled motor vehicle with a design speed not exceeding 50 km/h. If petrol-powered, its engine displacement must not exceed 50cc. If electric, motor power must not exceed 4 kW.

A person aged 16 or older may operate a qualifying moped. Rental companies can set a higher minimum rental age under their own policies.

For motorcycles, Vietnam's current licence classes distinguish between bikes up to 125cc / 11 kW and larger motorcycles.

Important: "50cc" is not just a marketing label

Do not assume a scooter is licence-free because a listing says "small scooter" or "electric scooter."

For a petrol scooter, check the actual engine displacement.

For an electric scooter, check both:

• motor power, and
• design speed.

If you are relying on the licence-free moped category, ask the rental company to confirm the vehicle's registered classification before you pay.

Do Foreign Tourists Need an International Driving Permit in Da Nang?

For a motorcycle that legally requires a licence, an ordinary home-country car licence is not enough.

Vietnamese law recognises an international driving permit issued by a country participating in the 1968 Vienna Convention on Road Traffic, provided you also carry the matching valid national driving licence for the vehicle category.

That means:

• the IDP must be a format Vietnam recognises;
• your national licence must still be valid;
• your national licence must include the correct motorcycle entitlement;
• the IDP does not create a motorcycle entitlement that your home licence does not already contain.

A car-only licence plus an IDP does not turn into a motorcycle licence.

Some countries do not issue a Vietnam-recognised 1968-format IDP. If that applies to you, do not assume an online "international licence" solves the problem. Check your situation before arriving.

Can I Rent a Scooter in Da Nang Without a Motorcycle Licence?

Yes, if you choose a vehicle that does not legally require a motorcycle licence and you meet the other legal conditions.

A 50cc scooter is best treated as a city and local-transport option. It is not a substitute for a larger motorcycle on every route. Performance is more limited with a passenger, luggage, steep climbs or long mountain sections.

Do I Need to Leave My Passport as a Deposit?

You should distinguish between showing your passport for identification and handing over the original passport as collateral.

Some rental businesses in Vietnam still ask to hold an original passport. Others use a cash deposit, passport copy or digital verification instead.

The UK government's current Vietnam travel advice specifically tells travelers not to give a passport to a motorcycle rental shop as a guarantee, because it can be held during a dispute over claimed damage.

A better arrangement is normally:

• show the passport for verification;
• allow the shop to record the necessary identity details;
• use a refundable deposit if required;
• keep the original passport with you.

How Much Is the Deposit?

There is no single Da Nang-wide deposit amount.

Deposits depend on:

• the shop's policy,
• and sometimes the renter's documentation.

Do not choose a rental based only on the smallest deposit.

• Is the deposit refundable in full?
• When is it returned?
• What can legally or contractually be deducted?
• Is there a written damage-price list?
• What happens if the motorbike is impounded?
• Is normal mechanical failure the renter's responsibility?
• Do I receive a written receipt for the deposit?

What Should the Rental Shop Give Me?

Before leaving, confirm that you have everything required for the rental and for normal road use.

At minimum, ask for:

• a written rental agreement;
• the rental company's contact number;
• the legally valid vehicle-registration document required for the scooter;
• proof of valid compulsory third-party liability insurance;
• at least one proper helmet per rider/passenger;
• the key and any lock supplied with the scooter;
• the agreed fuel policy;
• confirmation of the return time and late-return policy.

If a shop cannot clearly explain what documentation accompanies the bike, treat that as a warning sign.

Ask the rental company what registration document you will carry. Do not assume that an ordinary photocopy is automatically a legally valid substitute.

Does the Rental Price Include Insurance?

Never rely on the phrase "insurance included" without asking what it means.

There are several different things travelers may call "insurance":

• Vietnam's compulsory third-party liability insurance for the vehicle;

• What is the maximum permitted engine size?
• Do I need a motorcycle licence?
• Do I need an IDP?
• Is a passenger covered?
• Are mountain routes or long-distance riding excluded?
• Is medical evacuation covered?

Get the answer from the policy wording or insurer, not from the rental shop.

Can a Rental Shop Give Me a 125cc Scooter Without Checking My Licence?

Some businesses may still do so.

That does not change your legal status.

For two adults, a 50cc scooter will generally have:
